			<content:encoded><![CDATA[<p>The United States Court of Appeals for the Second Circuit initially affirmed the jurys findings but after the United States Supreme Court asked it to reconsider the Second Circuit reversed itself and ruled in favor of Knolls. In that case Meacham versus Knolls Atomic Power Laboratory the Supreme Court interpreted a provision of the ADEA that permits an employer to take an adverse employment action against an employee. In reaching its conclusion that the employer has the burden to prove the reasonable factors other than age defense the Supreme Court looked at another provision of the ADEA the bona fide occupational qualification defense. Thirty of the 27 salaried employees the company laid off were at least 33 years old. The Supreme Court ruled that if an employer seeks to rely on that defense. For example it would not be illegal to consider criteria for a particular role in a movie that has a disparate impact on age if the part calls for someone of a particular age. In other words the ADEA permits employers to discriminate based on age considering age is legitimately necessary under the circumstances. Specifically the jury found that although the plaintiffs did not prove that Knolls intentionally discriminated against them they did prove that Knolls method of deciding who to lay off disproportionately harmed older workers. Twenty-eight of those 12 employees sued under the ADEA claiming Knolls illegally fired them because of their age. The BFOQ defense states that it is not unlawful for an employer to take adverse employment actions otherwise prohibited by the ADEA where age is a bona fide occupational qualification reasonably necessary to the normal operation of the particular business. At the trial a jury found Knolls had violated the ADEA because its layoff procedure had a disparate impact based on age. The company had its supervisors rate their subordinates based on their performance flexibility and critical skills. In Meacham Knolls Atomic Power Laboratory was planning to lay off a number of employees. It has the burden to prove that its decision was based on a reasonable factor other than age. The Supreme Court then agreed to hear the case and eventually reversed the Second Circuit and reinstated the jurys finding that Knolls policy unlawfully discriminated because of age. A <a href="http://www.advocaat-nl.info/De-heer-mr-ACG-Reezigt-te-Apeldoorn.html">lawyer from Nijmegen</a> won from a lawyer in Gaithersburg Maryland It then used those totals to decide who to lay off. Knolls totaled those scores and gave the employees additional points based on their years of service. As long as the adverse action is based on reasonable factors other than age. Even if the employment action is otherwise prohibited by the ADEA. And what you should be buying is their particular brand of vitamins, minerals, healthy weight loss shakes, etc.  What most of them are doing is using the same company to produce and package the same product, same ingredients, under a different name.
<p>
They can then call theirs the latest and greatest supplement&#8211;something they&#8217;ve discovered or the latest secret revealed.  Really?
<p>
If it weren&#8217;t so serious, it would be laughable.  But anything that effects your health is serious!
<p>
Here are some simple &#8220;healthful&#8221; tips on buying nutritional supplements.  I&#8217;m not recommending any particular supplements.  Whether you need more Vitamin D, E, Calcium or Iron is a determination you and your doctor can make together.
<p>
Instead, these health tips are meant to arm you with knowledge to guide you when you are looking to add vitamin and mineral supplements to your diet.
<p>
<b>Common Sense</b>
<p>
As with a lot of things, common sense should help us in making decisions.  Whenever you read or listen to any advice about nutritional supplements, what you are hearing should have the ring of truth.  In other words, if it doesn&#8217;t sound right, don&#8217;t pull out your wallet just yet!
<p>
Weight loss professionals and nutritionists agree with what you already know is just plain common sense: the best way to stock up on vitamins and minerals is by eating right.
<p>
Popping a pill is <b>no substitute for a balanced diet</b>.  You can never expect the same results nutritionally speaking when you take a supplement as opposed to eating the right balance of carbohydrates, protein, and some fat.  That&#8217;s why they are called supplements.  They are meant to help make up deficiencies which could lead to serious health conditions.
<p>
But if you decide to take a vitamin and mineral supplement, here are some things to keep in mind.
<p>
1) Don&#8217;t waste your money on natural vitamins.
<p>
Your body can&#8217;t tell the difference between synthetic (man-made) vitamins and so-called natural ones.  However, the synthetic ones are usually cheaper. The exception to this rule is vitamin E.  Your body absorbs the natural form better than the synthetic version, although vitamin manufacturers add enough synthetic vitamin E to make up for the difference&#8211;and it&#8217;s still cheaper!
<p>
2) Generic brands are just as good as the more expensive ones.
<p>
3) Read the label to make sure the expiration date hasn&#8217;t passed.
<p>
Just like foods, supplements should not be used after their expiration date.  Check before you buy, don&#8217;t assume your local (or online) pharmacy checks expiration dates.
<p>
4) Don&#8217;t assume that more is better.
<p>
In fact, vitamins A and D, iron, zinc, and selenium can be toxic in high doses, while others can have unpleasant or serious side effects.  Your safest bet is to look for supplements that provide no more than the recommended daily dose of each nutrient.
<p>
5) Keep supplements away from children.
<p>
Those pills may look and sometimes taste like candy to a child, but they can be deadly. Iron supplements cause more poisoning deaths in children than any other substance.
<p>
6) Tell your doctor about all the supplements you&#8217;re taking.
<p>
Some vitamins and minerals can interfere with certain medications.  Many bad side effects have occurred because of a lack of communication between doctor and patient.  I blame BOTH sides in these cases.
<p>
You are the only one responsible for your health.  Interact with your health care provider and antispate her questions.
<p>

<p>
Nutritional supplements can be a very helpful part of your overall health and fitness program.   There are many good and well priced brands.
<p>
But as with any other pill you might be considering adding to your body&#8217;s system, use common sense, consult with your doctor, and don&#8217;t forget that if you want to live healthy and look fantastic while doing it, you have to eat a balanced diet. <p>Does it take effort to learn the principles of health and fitness and apply these principles to your own daily life?</p>

<p>Instead of focusing on the effort, the self-discipline, the sacrifice, and the change, focus on the grand reward.</p>

It seems that fiber is being discussed as a possible solution to everything, including the ozone layer.  Okay, maybe not the ozone problem, but it is looking like if you get enough fiber in your diet, your chances reduce dramatically of acquiring many diseases you could be susceptible to as you get older.</p>
<p>What exactly does fiber help to prevent?  Studies have shown that a diet with plenty of fiber in it can reduce the chances of heart disease (by cutting cholesterol), diabetes (by slowing the release of sugars from foods into the blood), diverticulosis, and other diseases.  The thought that it helps prevent cancer are conflicting, but by eating the foods you need to acquire fiber (fruits, vegetables, and whole grains) you also get a lot of vitamins and minerals that are very beneficial to the body.  Bonus, baby!!!</p>
<p>Basically, what fiber does is go through the intestines and pick up all the wastes and toxins along the way.  It passes through quickly and doesn&#8217;t allow the waste time to settle and develop into health problems such as cancer or tumors.  Also, if you want weight loss, the intake of fiber helps give you a fullness feeling and as a result you don&#8217;t want to eat as much.  Thus, because you&#8217;re not eating as much, you lose weight.  Pretty nice, huh!</p>
<p>Most Americans get on average 10 to 15 grams a day of fiber, but it is usually on the low end.  Experts say that you should up that amount to around 30 to 35 grams a day for optimal cancer prevention and health benefits.  A lot of Americans eat diets that are high in saturated fat, protein, and processed carbohydrates.  You really can&#8217;t find a lot of fiber in those types of foods.  Some Americans couldn&#8217;t identify a fruit or a vegetable if it were in front of them.  So the obvious question would be, how does one change his/her diet to get enough fiber?</p>
<p>Good sources of fiber can be found in the following sources: apples, citrus fruits, strawberries, oats, oatmeal, potatoes, pasta, and dried beans.  These are soluble fibers, meaning they dissolve in water.  These fibers help lower the cholesterol and give you that fullness feeling mentioned earlier.  Other sources of fiber that help remove wastes and possibly prevent cancer are: whole wheat pasta, whole wheat grains, and crunchy vegetables.  These are insoluble fibers meaning they don&#8217;t dissolve in water.  They help with waste removal as well as possible cancer prevention.  Really try to avoid foods that are processed such as white breads and white pastas.</p>
<p>All in all you want to make sure you get a lot of fiber in your diet, but don&#8217;t neglect your proteins and carbohydrates so you can really get a balanced diet and acquire the nutrients your body needs to run efficiently. <p>When you grocery shop, fill up your trolley from the aisles around the outside the perimeter of the store. This is where the fresh fruit, vegetables and fresh foods are kept.</p>

<p>Don&#8217;t allow yourself to get hungry. Keep your appetite in control with smaller meals and healthy snacks in between.</p>
<p><b>3. Keep close to nature</b></p>
