A typical day at the inbox

Today, I received 374 e-mails total.

A pretty light day considering some days I get more than 1,000.

To clarify what they were–35 were for business, 4 were personal in nature, 11 were from groups I asked to get information from like Neiman Marcus and Urban Outfitters, VH1, and a PR Newsletter.

The balance of 324 was unsolicited (UCE-unsolicited commercial e-mail)–in other words spam.

If I extrapolate the UCE I’ve gotten in the last six hours alone, I find I must be missing something about myself on some spiritual level..

I am a balding, fat man with a small penis that doesn’t work. I am in debt.

I am looking for a lower interest rate on my mortgage while at the same time making thousands of dollars with no effort on my part in the privacy of my own homefilling out surveys, stuffing envelopes and not selling something that miraculously sells itself.

Even better, I can be a travel agent without wrinkles; obtain a college degree while waiting for my 1500 advance to show up in my bank account; I can restore my credit rating legally while watching my free satellite TV and munching on my drugs sent courtesy of an offshore pharmacy that has a doctor who will write me a prescription… HMMM…definitely something to consider. NOT.

I’ve also discovered that I am a prime candidate to help an African Prince transfer funds into the US. He trusts me. All I have to do is give him my bank account information.

The problem is that I am a woman who doesn’t suffer those ills.
Someone thinks I do…There is something wrong with this picture.

The future of bulk email and why it is likely to remain dead

Now, you might be asking why I, who was dubbed the “Spam Queen”
in the “Wall Street Journal” three years ago, am even bothering to say anything about e-mail?

Just to set the record straight, I have never advocated spam or sending spam.

One reporter said to me, “Some people consider all bulk email as spam. What do you have to say about that?” to which I replied, “Then I guess you’d call me the spam queen,” as a joke.

In our sound byte media world, one editor turned this little quip into a buzzword and I became known almost instantly, all over the world, as representing what everyone, including myself, hates about email.

The media as usual emphasized sensationalism and missed the point.

I am not complaining because my marketing business skyrocketed as a result.

At that time I advocated email as a very effective medium for small business, which because of its low cost lets small businesses level the playing field against big corporations.

At no small personal risk, I visited the Federal Trade Commission in Washington, DC, and spoke my peace about small businesses and not throwing out the baby with the bathwater before even the very term spam could be legally agreed upon and defined to the satisfaction of marketers, ISPs and the government jointly.

Small businesses are the lifeblood of the US economy, and entrepreneurs with their dreams are what have made the US the economic powerhouse it still is today.

Email that is sent to people who WANT to receive it, and that is in accordance with their preferences, still gets a high response. It allows many small businesses to get ahead. I didn’t want to see big corporations or the government take over email and bar entry, filter, and extort everyone else while still sending their own advertising messages freely.

And then came the Can-Spam act, which I and many other legitimate marketers welcomed, because it had a great promise of getting rid of the noise while keeping the signal.

As it turned out, the opposite happened. Email filters from ISP’s now block a large amount of legitimate messages, which they call “false positives”.

Marketers can’t send the text they would like to send to their subscribers, so they have to resort to filter tricking tactics such as spelling the word spam as sp@@@M so that they can get past the filters that were intended for another purpose entirely.

In a climate like this, legitimate companies that had been diligently following best practices, and keeping their lists clean for years, suddenly did not want to stay in business with ambiguities in the law and the potential litigation that might ensue even if all the rules WERE followed, so many companies just folded.

However the people that continue to send email illegally did not fold.

Often times sending from outside the US borders, they stepped up their operations even more, to the point that there is almost no truly legitimate bulk email left.

In other words, the signal has become lost in the noise.

The simplicity is this bulk commercial e-mail has gotten to the point where it isn’t effective. We just don’t do it anymore. What’s the point? It doesn’t get a response, and we found people are overloaded with advertising messages and no longer willing to receive more, especially in their inbox, unless they specifically asked for it.

As a marketing professional, the only thing that should count for you at the end of the day is effectiveness. Bulk commercial e-mail has turned into the above, a bunch of unprofessional, ineffective scams.

In other words, Spam is a four-letter word.

Legitimate marketers are staying away in droves and it’s easy to see why. First of all let’s look at some facts. In the United States, it is legal to send unsolicited commercial e-mail. The CAN SPAM act allows for this. You have to provide a way to opt-out and not hide who you are, and a few more simple but ethical rules.

Although it is legal, there isn’t an internet service provider in the United States who will allow you to send unsolicited commercial e-mail.

Larger mailers have opt-in information from lists they purchase which imply consent but those lists aren’t originated from the mailer, but from other sub-mailersyou get a free thing or access to a particular site and the user checks a box that it is okay to get information from their “affiliates and partners.”

The “affiliates and partners” they are referring to are those who pay for the e-mail addresses and opt-in information.

These guys are sending you mail legally, but the fact is, they are not getting into your e-mail box for the most part. Blocking, filtering, and doing it the “legal” way bulk wise, is just not working.

Not to mention, there is no way to prove that the recipients opted in or are willing to get the message since they opted in at someone else’s site, not yours.

The response rate is pathetic and when that mail does get through, you have many disgruntled individuals who never remember opting in, so in their view, the mail is unsolicited. The only way to get e-mail into inboxes en masse is by not following the rules, so the only messages getting through are the scams, including the pornographic, illegal, and objectionable.

It is ironic that the very thing people want to rail against, they are getting more of in the aftermath of Can-Spam.

So where does that leave us?

What can a small businessperson do to get their message out, and not break their bank?

If you are a small businessperson, there are 3 alternatives that you should consider, which are described in this next section:

What is effective you might ask? (Ask away, it’s kind of the point here..)

1) First party offers that impart some value added (a tip; some information, something the consumer is interested in.)

Lets say John Q. Consumer gave his e-mail address for a newsletter, or for more information on a particular subject, or to play a game.

Chances are he probably would not be angered to get an e-mail from your company especially since he asked for you to contact him. He would recognize your domain name since he spent enough time on your site to actually ask the info.

Additionally, your internet service provider would not shut you down for violations and you’d start to build a small but effective list of people who are actually interested in what you, as a business owner, have to say.

This has been effective since the beginning of the internet. The only problem is, how do you reach people the first time, to get them to your site?

How do you find a target market for your products that is likely to be interested in what you have to offer and sign up for your newsletter, visit your site, and hopefully buy your stuff?

Is there anything less costly than television, radio, and (ugh!) banner ads?

Yes there is. Drum roll please…..Search Engine Marketing. If you write good ads, and compete with the right keywords, people who are already searching for an answer to a question, doing research, comparison shopping will go to a search engine and type in their parameters.

If you know how to market well, only people who are interested will go to your site.

If you have a web site that is compelling and you are offering a value added, they will ask for more information or sign up for your newsletter, or get your free download.

Now, getting to this point can sometimes take a little time, but if you are persistent, and know how to interpret your statistics, you can do this. If you want the result without the learning curve, hire a Search Engine Marketing Firm.

“Hello there, my name is James … James Bond and I am … well … a Realtor”. In the Greater Vancouver area there have been an abundance of famous real estate Agents at any given time, at least famous by name that is. In addition to James Bond and, of course, my own last name (’ Frascati’ is one of the famous wines of Italy as well as the seventh hill of Rome ), we have had Agents the caliber of Omar Sharif, Vera Cruz, Charlie F. Brown and one Giuseppe Mussolini ( you could spot him on the street because he wore invariably a black shirt and had that certain martial … how should I say … goose step …). Not to mention Yuri Gagarin ( no relation to the astronaut ), Carl Marx, Richard (Dick) Nixon and - yes - Douglas MacArthur ( tough guy to deal with … ) with his newly-found pal John Yamamoto, to name some more. And, faithful to the oriental tradition that characterizes this neck of the woods, we have been sporting at various times a Ding Dong, a King Woo Kong as well as a Sing T. Sing, a Wu Win-chi Wu ( who used the initials WWW ) and two Ho Chi Minh’s. The longest name I have ever come across is Guillermo Oreporemotichovea ( but his friends called him ‘Cy’ … no wonder ) and the most memorable slogan ever adopted, to my knowledge, by a Realtor belongs to an Agent by the name of Bob Bye ( now defunct, possibly of starvation … ) who used to post ads on the paper the likes of ” List with Bob Bye - The Guy with the Tie “. Yet, despite the variety of names and walks of life, all Agents - especially in real estate - must abide to the axioms of the Law of Agency when it comes to fulfilling their professional mandates.

An Agent is a person who is authorized to act on another person’s behalf. The person for whom he acts is called his Principal. Because the Agent has authority given to him by the Principal, he can create a legal relationship between the Principal and a third party. For example, a purchasing agent can order goods from a third party on behalf of his principal, so long as the purchase is made within the scope of the agent’s authority. In such instance, the principal must pay for the goods because he is effectively bound by the agent in a contract with the third party. The agent, on the other hand, is not a party to the contract.

The relationship between an agent and his principal is created by contract. Under the Agency Contract the agent is given authority to do certain things in his principal’s place. In exchange for the service provided by the agent to act on his principal’s behalf, the principal pays the agent a fee or commission. Agents are not employees. The distinction between an agent and an employee is the degree of control and method of remuneration. A principal tells the agent what he wants and leaves it to the agent how to bring about the result. An employer, on the other hand, tells the employee what to do and how to do it. Furthermore, the agent is usually paid by way of a commission that becomes payable only when he brings in the result. An employee, instead, expects to be remunerated for the number of hours he works regardless of whether or not the result is accomplished. Real Estate Agents are a particular kind of agents. A real estate agent acts on behalf of his principal, almost always the Seller, but can also act on behalf of a Buyer and can, in fact, act on behalf of both Seller and Buyer at the same time subject to certain restrictions. The contract that spells out the terms and conditions of the authority confered by a Seller to the real estate agent is called the Listing Agreement. With the Buyer, the name changes to Buyer’s Agency Agreement.

Based upon the wording of the contractual agreement between the principal and the agent, the authority to act confered upon the agent falls into one or more than one of the following categories. The agent’s authority to act can be express, implied, , by ratification, , usual, and apparent, .

Express Authority

Express authority is the authority given by to the agent by the contract. The contract can be in writing or verbal. Real estate agents are given usually express authority under a Listing Agreement and here in British Columbia all listing agreements involving land or an interest in land ( such as a lease ) must be in writing in order to be enforceable, pursuant to the Real Estate Services Act . It must be understood that a listing agreement is not a contract to sell or otherwise convey an interest in land but, rather, an agreement by and through which one party ( the Agent ) agrees to market an interest in land and the other party ( the Principal ) agrees to pay a commission on completion.

Implied Authority

Even when precise words are used in the express authority, an agent may find himself in circumstances where the acts he wants to do are not covered by those words. It is sometimes possible to imply authority from the precise words. More specifically, an agent would have implied authority to carry out an act if the agent has no choice but to do it in order to fulfill his express authority. For example, a real estate agent’s authority may be only to sell a certain parcel of land or a certain house for his principal. The agent may wish to show the property to prospective purchasers during the owner’s absence. If the agent had no authority to do so both he and the prospective purchasers would be trespassers and, therefore, liable to the owner in damages. Because showing a property is necessary and incidental to effecting a sale, the agent can imply the authority proximately from his express authority, provided nothing in the contract states otherwise.

Authority by Ratification

Sometimes an authority can be created retroactively. For example, where an agent enters into a contract on behalf of his principal but the contract is beyond the agent’s express authority, he can be given authority in the past. This is done by ratification. If the principal consents after the fact to be bound by the unauthorized acts of his agent, he has ratified the contract. The end result is, therefore, that the principal is bound by the contract just as if the agent had been so authorized in the first place.

Usual Authority

Usual authority arises when an agent is engaged by the principal to act in a particular transaction and such transaction is governed by ‘customs of the trade’ . In such case the principal is considered to have consented to the agent acting in accordance with such customs, as long as they are lawful and reasonable and the principal has not indicated otherwise.

Apparent Authority

Under certain circumstances, furthermore, an agent can bind his principal to a third party even though the agent was not authorized to do so. This arises where a principal has acted in such a way that he leads third parties to believe his agent has authority to perform certain acts on his behalf. If the third party deals with the agent in the bona fide belief that the agent has the authority represented, it is called apparent authority.

In general, any person of sound mind can act as an agent, since the agent does not need to have the capacity to contract out that the principal must have ( refer to my Article entitled ‘Fundamentals of Contract Law’ for further information ). As a result, an infant agent ( i.e. an agent under the age of majority ) can negotiate a binding contract between the principal and a third party. The infant agent is, however, a party to the agency contract and could therefore use his own incapacity to contract out to repudiate the agency contract with his own principal.

avoiding disappointment. Listen to the lunch table talk of those
around you-perhaps even your own talk-do you hear expectations
of happiness?

There is much social research-as well as spiritual teaching-
supporting the theory that we get what we expect. Expect to be
happy and you will be. Expect to be unhappy and that, too, will
come to you.

So the first key to your happiness is that you must believe that
happiness is possible for you. If this is too difficult a belief
based on where you are now, then accept that happiness is coming
soon. You must begin your quest for happiness with a positive
foundation. At the very least, make a bargain with yourself. For
thirty days, allow yourself to believe happiness is not only
possible, but on the way. You have nothing to lose, so give it a
try.

2. Find three things to appreciate at the start and end of each
day. This second key to happiness is all about recognizing that
which you already have. Even the dreariest of days and the most
onerous life circumstances have some positive aspects. Start
your day by finding three things to appreciate. This can be as
basic as appreciating that you woke up to another day and you’re
alive. Appreciate the weather, not just a sunny day, but also a
cloudy day. See the beauty in a rain or snow storm. Appreciate
your job if you have one, even if you dislike it. Appreciate
your car, even if it’s a clunker. Find three things for which
you can summon up an appreciative mood.

At the end of the day, repeat this process. This time focus your
appreciation on three events of the day. Something good must
have happened to you today-after all, you’re still alive.
Appreciate something new you learned today, even if it was that
you can survive a dressing down by an irate customer. Appreciate
the welcome you received from your spouse, child, or pet, the
safety of your home, or that you have food for dinner.

3. Accept, change, or separate from that which prevents your
happiness. Don’t dwell on the sources of unhappiness in your
life, but do notice them. The third key is to make the conscious
decision to do one of the only three things you can ever do to
change a source of unhappiness-fully accept it, work to change
it, or separate from it. These are your choices unless you
really don’t want a change-the choice to remain unhappy so you
can feel the victim is also available. Many people choose this
one.

Fully accepting something means embracing it as your own-
choosing it. It doesn’t mean whining or complaining about it. It
doesn’t mean pretending it isn’t there. It means accepting it as
part of your life. If that isn’t feasible for you, then…

Work to change it. If your source of unhappiness is a lousy
job-something you just can’t contemplate continuing for more
than a few months-consider how you might change it. Do you have
any room within this job to change some aspect of what you do or
how you go about doing the job? Are there problems outside your
responsibility that interest you? Ask your boss if you can take
on a problem in addition to your regular responsibilities. Few
bosses will begrudge you taking on more work. Perhaps you can
gradually shift your responsibilities to things that are more
interesting and better aligned to your abilities. If you can see
no possible way to change your situation, then…

Decide to separate yourself from the source of unhappiness. Life
is too short to continue in a situation that you can’t accept
and you can’t change. So leave it. Even in this poor economy
with many people out of work, there are still jobs available.
Start looking-unless you prefer to keep things just as they are
and complain. Be honest with yourself about this. Some people
really do prefer to complain than to correct.

4. Focus on that which makes you happy. The fourth key is to
consciously control your thinking so that you focus all your
thoughts, all your energy, and all your time on things that make
you happy. Simply decide to reside within the positive areas of
your life. This may initially impress you as
“sticking-your-head-in-the-sand,”-but it’s not. Life surrounds
us with diverse experiences. We can choose those to which we
give our attention. Does it make you happy or unhappy when your
lunch crowd starts whining and complaining? Steer the
conversation to something more positive. Or mentally distance
yourself and enjoy the drama that each person is playing. Avoid
feeling sorry for yourself, bitter about your bad luck, or
envious of others. Stick with thoughts and activities that feel
good and watch your happiness index go up.

Strategic planning throughout the year results in a minimal tax balance. The objective of planning your tax payables is not to prevent paying taxes, it is to pay no more than your fair share of taxes, and keep your money where it earns you the most.

If you aren’t aware of it yet, Uncle Sam pays no interest. If he deducts your tax payment monthly or quarterly, and takes more than his fair share, he doesn’t give you anything back for the privilege of using your hard earned money. By the same token, if you don’t pay in enough, he charges you a penalty and interest.

As a W-2 wage earner, if you are over paying your tax debt, you may be considering it a ‘forced savings plan’, but you gain nothing, using that particular plan. By putting the same amount in savings every year, earning interest on the balance, and continuing to regularly invest in your savings fund, you may be able to utilize the retirement savings plan reducing your tax debt significantly. With the advice of a competent tax consultant, your savings can become an investment with a tax reduction at the end of the year.

As a business owner paying tax quarterly, over paying your taxes can cost you considerably more. Your tax debt may actually be borrowed money, on a line of credit from the bank where you pay interest for the use of the money. If tax planning were part of your business expenses, you get to deduct the amount paid to the tax consultant from your business, you don’t have to pay interest on more than you need to pay in (if using a line of credit to pay taxes), and any saved money can be placed in a retirement fund or savings plan to draw interest for you. Once again, a tax consultant can save you money.
